General Policies

Please read this page with care, as it explains the policies of being a member of the Indesouk community. These policies only apply to Indesouk.com. If you still have questions after reading these policies, please feel free to contact us.

Market Stall (Sellers)

We expect all members of Indesouk to treat each other with integrity and respect. Your Market Stall name on Indesouk is your identity. You are responsible for your conduct and all content submitted under your Market Stall name on Indesouk.

  • By joining Indesouk, you agree to abide by the policies outlined here and in our Terms of Use.
  • Stall names and your URL cannot be changed except in the event of documented legal action (such as trademark infringement) at Indesouk's discretion. Choose your stall name carefully.
  • You must be at least 18 years of age to hold an account on Indesouk.
  • You must have a PayPal business account. You must use your PayPal business account as your e-mail on Indesouk to be able to receive payments.
  • You must have a Tumblr account in order to participate in Indesouk blog.
  • You may not use mature, profane or racist language or images in your username, or designer profile.
  • You may not transfer ownership or sell your Indesouk account to another party.
  • You may not use Indesouk to direct buyers to another online selling venue to purchase the same items as listed in your Indesouk shop, as this may constitute fee avoidance. This includes posting links/URLs or providing information sufficient to locate the other online venue(s).
  • An Indesouk account may not be used for the purpose of redirecting traffic to another web location.
  • Keep your account information updated and accurate. Your account must have a valid email address at all times. Indesouk will use the email address on file in your account information to contact you when necessary.
  • Indesouk encourages all members to resolve their own disputes. As a venue, Indesouk cannot mediate disputes between members or other parties.
  • A seller must create a buyer’s account in order to shop in Indesouk. The Seller can use the same email address for the buyer account.

Members who do not comply with Indesouk’s policies may be subject to review, which can result in suspension of account privileges and/or termination. This includes all of your accounts by virtue of association. In other words, Indesouk reserves the right to suspend the use of the site for a person and all username(s) he/she operates under.

Transactions

Indesouk is a venue not a retailer; Indesouk's role is to connect the buyer and the seller. This means when you place an order on Indesouk, you are entering into a direct transaction with an individual seller. We encourage the two parties to independently work through the transaction to completion.

A transaction is created when a buyer completes Indesouk's checkout process. The seller and buyer will receive email notification from Indesouk with information about the transaction. An Indesouk transaction is completed when the buyer receives the item. Payment is submitted directly to the seller via Paypal or credit card.

In certain circumstances, a seller may cancel an invalid or void transaction or refuse service to a buyer. A seller may post important information in the community tumblr blog or listing description to better inform buyers. All market stalls must comply with Indesouk's site-wide policies. Please note: other services involved in completing a transaction (for example: PayPal.com, shipping services) may have different policies regarding transactions.

Transaction policies for the seller:

  • The seller must sell the item(s) to the buyer with whom the transaction is created, unless the transaction is eligible for cancellation.
  • The seller must ship the item(s) as described
  • The seller must ship the item(s) within a reasonable amount of time or within 3 working days from the time the transaction is created. The seller must update the Order Status in the Seller’s Dashboard.
  • The seller must ship the item(s) to the shipping address submitted by the buyer.
  • In the event of a dispute, the seller may be asked to provide Indesouk with proof of shipping. Indesouk will not hold the seller responsible for postal or shipping service delays or errors, theft or customs delays.

Transaction policies for the buyer:

  • The buyer must have a Paypal Account or valid credit card in order to proceed with the transaction.
  • The buyer must pay the seller directly. Do not send payment to Indesouk.
  • The buyer must pay at the time the transaction is created
  • The buyer must submit valid shipping and payment information to the seller
  • In the event of a dispute concerning the return of the item(s) to a seller, the buyer may be asked to provide Indesouk with proof of shipping back to the seller. Indesouk will not hold the buyer responsible for postal or shipping service delays or errors, theft or customs delays when returning items to the seller.

Members who do not comply with Indesouk's policies may be subject to review, which can result in suspension of account privileges and/or termination.

Transaction concerns or disputes

We hope that the shopping experience on Indesouk is smooth and hassle-free. In the event of a transaction dispute, Indesouk encourages the buyer and seller to resolve the situation through email and by submitting fair, honest feedback. The policies below describe various types of transaction disputes and the roles of the seller, the buyer and Indesouk in each scenario.

Non-delivery

Non-delivery occurs when a seller does not or cannot ship an item after a transaction has been created and the buyer has sent payment to the seller. The buyer may contact Indesouk through hello@indesouk.com to file a non-delivery report or statement. When a non-delivery report is filed, both the buyer and the seller receive a notice from Indesouk about the report so they can work out the issue. Indesouk encourages all sellers to keep records regarding proof of shipping (for example: delivery confirmation, shipping service receipt, customs form). Indesouk relies on buyers to submit fair, honest feedback for sellers in non-delivery circumstances. Please note: a buyer who paid a seller via PayPal may have a limited time frame in which to file a claim for refund of purchase under PayPal's policies.

  • The seller must ship goods within a reasonable amount of time or within 3 working days from when a transaction is created. The seller must update the Order Status on the Seller’s Dashboard.
  • The seller must respond to a non-delivery report by contacting Indesouk. A non-delivery report cannot be closed until the seller contacts Indesouk at hello@indesouk.com
  • The seller may be asked to provide Indesouk with proof of shipping in the event of a dispute.

A seller who fails to ship an item, respond to a non-delivery report or settle a disputed transaction in a reasonable manner may be suspended. Members who do not comply with Indesouk's policies may be subject to review, which can result in suspension of account privileges and/or termination.

Refusing service

Indesouk encourages sellers to engage in clear and consistent communication and honor transaction agreements. However, if a seller cannot complete a transaction due to an extraordinary circumstance, then the seller may refuse service to the buyer.

  • The seller must notify the buyer of refusal of service through email
  • The seller can only refuse service prior to shipping.
  • If the buyer has already paid, then the seller must refund the buyer (price paid for item plus shipping).
  • The seller may cancel the transaction when applicable
  • Unless otherwise agreed or according to the seller's terms, a seller's refusal of service to a specific buyer is indefinite within that seller's Indesouk market stall.

Members who abuse the privilege to refuse service may be subject to review, which can result in suspension of account privileges and/or termination.

Dissatisfaction with item or service

A buyer may not be completely satisfied with a purchase or transaction experience. Indesouk recommends that the buyer communicate with the seller by email to resolve the matter. Indesouk encourages buyers to submit fair, honest feedback to Indesouk. Sellers are encouraged to:

  • Accurately describe the item in the listing
  • Comply with the transaction agreement

In the event the buyer receives a item that is significantly different from the original listing, the buyer may contact Indesouk to report the item not as described. Members who do not comply with Indesouk's policies may be subject to review, which can result in suspension of account privileges and/or termination.

Interference

To ensure the integrity of Indesouk's marketplace and help protect members from potentially fraudulent activity, transaction interference is not allowed on Indesouk. The following circumstances are considered transaction interference:

  • You may not contact another member to buy or sell an item listed on Indesouk outside of Indesouk's marketplace. This may also constitute fee avoidance.
  • You may not communicate with a member involved in an active or completed transaction to warn the member away from a particular buyer, seller or item.

Members who do not comply with Indesouk's policies may be subject to review, which can result in suspension of account privileges and/or termination.

Transaction cancellation

On occasion, a seller may need to cancel an invalid or void transaction. When applicable, Indesouk will issue a refund to the seller for the applicable fees and remove the transaction from Indesouk. Only the seller in a transaction may cancel the transaction through the Order Status of the transaction on the Seller’s Dashboard. The buyer should contact the seller by email to request cancellation of a transaction. The buyer may contact Indesouk if the seller does not respond to a request to cancel a transaction. Item returns are subject to Indesouk’s Return and Exchange site-wide policies; the buyer needs to contact the seller for approval prior to shipping an item back to the seller.

  • The seller may not cancel a transaction for the purpose of avoiding fees or feedback.
  • The seller may cancel an invalid or void transaction, as defined by these circumstances:
    • Both the buyer and seller agree to cancel the transaction prior to shipment. If the buyer has already paid, the seller has refunded buyer (price paid for item plus shipping).
    • The seller has refused service to the buyer. If the buyer has already paid, the seller has refunded the buyer (price paid for item plus shipping).
    • The buyer paid for the item(s). Although the seller shipped the item(s), the buyer did not receive the item(s). The seller has refunded the buyer (price paid for item at minimum).
    • The buyer paid, the seller shipped the item, and the buyer received the item. Then the buyer and seller agreed the buyer can return the item to the seller for a refund. The seller has received the returned item, and the seller has refunded the buyer (price paid for item at minimum).

Members who abuse the privilege to cancel transactions may be subject to review, which can result in suspension of account privileges and/or termination.

Market Stalls

Indesouk provides a marketplace for fashion, jewellery and accessory designers to sell their work.

We encourage all sellers to provide information about yourself and/or your design in your Market Stall Profile. Buyers will likely be interested in this information, as they are often here specifically to buy innovative designs.

Please keep the following things in mind as you set up your market stall and create listings:

  • Market Stall policies must abide by Indesouk's site-wide policies.
  • Do not make illegal use of photographs or written text. This is in violation of our Terms of Use.
  • Use of mature, profane and/or racist language or images in the public areas of your Indesouk shop is not permitted. This includes your username, Market Stall Profile, item titles, tags, logo, banner, and/or shop sections.
  • You may not set a minimum purchase amount requirement in your shop.
  • You may not engage in any activity to avoid Indesouk's fees ("fee avoidance"). This includes but is not limited to: completing a transaction off-Indesouk once it has been initiated on the site, listing an item below its intended purchase price or cancelling a valid completed transaction.

Members who do not comply with Indesouk's policies may be subject to review, which can result in suspension of account privileges and/or termination.

Listings

All listings on Indesouk should be clear, accurate and detailed. Accurate titles, photos and descriptions are critical to selling on Indesouk. Keep these policies in mind as you list and describe your items:

  • You must create listings for at least three items in your Market Stall. Indesouk recommends nine items to provide variety to buyers.
  • Listing descriptions and photos must accurately describe the item for sale so buyers know what is included in the purchase.
    • You must provide at least two photos for each item listing. Photos must be done professionally. Indesouk recommends four photos for each listing. Three of these photos must display various angels of the listing eg. Front, side and back. One photo must display a detailed shot.
  • Each listing must be available for purchase.
    • You may not create a listing for an item that is not for sale or sold out. Custom-made items are allowed.
    • You may upload items at its original retail price. You may not discount an item from its original retail price, unless instructed by Indesouk.
    • A listing may not be created for the sole purpose of sharing photographs or other information with the community.
    • A listing may not be created solely as an advertisement. This includes notices of sales or promotions in your shop. Such information may be included in your Market Stall Profile, logo and/or item descriptions.
    • Items must not be listed as available for rental or lease.
  • Listing prices must be reasonable.
    • You may price an item how you choose; however, a listing should not be created with an inaccurate price in order to keep it from selling.
    • Shipping cost is valid for one item in your market stall. Although Indesouk recommends a local and international shipping price, sellers can change the shipping cost when it is reasonable for the item.
  • You may not edit a listing's information to change it to an entirely different item
  • All listings on Indesouk must be for a tangible object. (Note: a digital file is considered a tangible object.)
  • You may not use Indesouk to direct buyers to another online selling venue to purchase the same items as listed in your Indesouk market stall, as this may constitute fee avoidance. This includes posting links/URLs or providing information sufficient to locate the other online venue(s).
  • A listing must not be conditional upon the purchase of another listing in your shop (for example: saying "this item may only be purchased along with another item in my shop" is not allowed). This includes listings for item upgrades, shipping upgrades and gift wrapping upgrades.
  • A free with purchase item may not be listed as a separate listing conditional upon the purchase of another item in your shop.
    • The title and tags must not mention or describe the free with purchase item.
    • Information about free with purchase items may only be included in the item description.
    • A free with purchase item must not be featured in the first photograph of the listing.
    • The listing price must only reflect the listed item.
  • Gift certificates cannot be listed on Indesouk.
  • Drop shipping is not permitted. All items must be shipped under the direct supervision of the seller.

Listings that do not comply with Indesouk's policies may be flagged for review. Members who do not comply with Indesouk's policies may be subject to review, which can result in suspension of account privileges and/or termination.

Shipping

You are responsible for shipping an item to the buyer. You are responsible for any theft and accidental damage while the order is in transit to the buyer. It is recommended that you insure items while in transit. Once the order is delivered to the buyer’s address or signed for, you are no longer responsible for any theft or damages on the item. Seller must agree to use a shipping or postal service that allows local customers to receive the order within 2-5 days upon shipment and international customers to receive the order within 5-10 days upon shipment.


Item Policy

  • Items must be designed by the seller
  • Items must be made of highest quality
  • Items must be sustainable either from raw materials, item development and processes. As much as possible, Indesouk prefers items made with natural materials or blends with higher natural content.
  • Items must be innovative. They must constantly challenge existing designs.

Items that do not comply with Indesouk's policies may be flagged for review. Members who do not comply with Indesouk's policies may be subject to review, which can result in suspension of account privileges and/or termination.

Photography

  • Uploaded item photos must be photographed in professional quality  
  • Fashion clothing must be photographed with a model
  • Fashion accessories and jewelry must be photographed against white background and with a model

Photos that do not comply with Indesouk's policies may be flagged for review. Members who do not comply with Indesouk's policies may be subject to review, which can result in suspension of account privileges and/or termination.

Returns/Exchange and Refunds

Indesouk applies a site-wide Returns and Exchange policy:

Buyers are entitled to a full refund, return or exchange within five days of item receipt. Sellers are encouraged to create their own Market Stall policies as long as this conforms to Indesouk’s policies. 

To return or exchange an item, the Buyer must contact Seller within five days of item receipt and both Buyer and Seller must agree on return or exchange. If both parties agree, the buyer must ship the item to the seller at the buyer’s expense. The items must be returned new, unused and with all tags still attached (if applicable). If the seller finds the returned item in good condition the seller must refund the buyer in full. A full refund includes Price of Item and Original shipping fee.

After refunding, the seller must report the transaction as cancelled by changing the Order Status on the Seller’s Dashboard. Upon changing the Order Status, the Seller can request for Indesouk’s fee refund. If there is a reasonable explanation to the transaction cancellation then Indesouk’s fee will be refunded. Indesouk has the right to refuse refund to the seller.

Members who abuse the privilege of transaction cancellation may be subject to review, which can result in suspension of account privileges and/or termination.

Mature content

Indesouk aims to maintain a marketplace appropriate for general audiences, therefore the use of mature content must comply with the following policies. Mature content is defined as: visual depiction of male or female genitalia, sexual activity or content, profane language or graphic violence. Mature content listings will remain in all Indesouk searches by default; users can restrict results by using the exclusionary search term "-mature" ("opt-out" search status).

  • Mature content and/or profane language or images are not allowed in your username, Public Profile.
  • All images in your item listing should be kept appropriate for general audiences; additional images in the listing may show the item in its entirety. Mature content and/or profane language or images are only allowed in the second, third, fourth and fifth photos of an item listing and the description text of a listing.
  • Pornography is prohibited on Indesouk.

Members who do not comply with Indesouk's policies may be subject to review, which can result in suspension of account privileges and/or termination. If Indesouk removes an item listing for violating Indesouk policy, the seller is still obligated to pay the listing fee for that item. Suspended or terminated members remain obligated to pay Indesouk for all unpaid fees per our Terms of Use.

Prohibited items

Every Indesouk seller is responsible for following the laws that apply to you, your shop and your items, including any shipping restrictions for your items.

There are some types of items that we don't allow in Indesouk's marketplace, even if they are legal and otherwise meet Indesouk's selling criteria. Some things just aren't in the spirit of Indesouk. The following types of items may not be listed on Indesouk:

  • Alcohol
  • Tobacco
  • Drugs, drug-like substances, drug paraphernalia
  • Live animals, illegal animal items
  • Pornography
  • Firearms and/or weapons
  • Recalled items
  • Real estate
  • Motor vehicles (automobiles, motorcycles, boats, etc.)
  • Items or listings that promote, support or glorify hatred toward or otherwise demean people based upon: race, ethnicity, religion, gender, gender identity, disability, or sexual orientation; including items or content that promote organizations with such views
  • Items or listings that promote or support illegal activity or instruct others to engage in illegal activity
  • Items or listings that promote, support or glorify acts of violence or harm towards self or others

Even beyond these standards, Indesouk members are responsible for making important moral or ethical decisions regarding what they buy and sell on Indesouk.

We reserve the right to remove listings that we determine are not within the spirit of Indesouk. Such listings will be removed from the site, and the member's selling privileges may be suspended and/or terminated. If Indesouk removes an item listing for violating Indesouk policy, the seller is still obligated to pay the listing fee for that item. Suspended or terminated members remain obligated to pay Indesouk for all unpaid fees per our Terms of Use.
